Beach Tennis Life – Junior Tour 2024 @ Festival Olímpico de Playa – February 11, 2024
In consideration of being permitted to participate in any way in Beach Tennis Life – Junior Tour 2024 @ Festival Olímpico de Playa – February 11, 2024, and its activities (“Activity”) I (We), for myself for personal representatives, assigns, heirs and next of kin:
1) ACKNOWLEDGE, agree, and represent that I (We) understand the nature of the Beach Tennis Life – Junior Tour 2024 @ Festival Olímpico de Playa, to be held on February 11, 2024, at the premises of Balneario de Punta Salinas, Toa Baja, Puerto Rico and that I (We) am (are) qualified, in good health and in proper physical condition to participate in such activity. I (We) further agree and warrant that if at any time I (We) believe conditions to be unsafe, I (We) will immediately discontinue further participation in the Activity.
2) FULLY UNDERSTAND THAT: (a) THIS SPORTS ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS,AND DEATH (“RISK”); (b) these Risks and danger may be caused by my own actions or inaction, the action or inaction of other participating in the Activity, the condition in which the Activity take place, or THE NEGLIGENCE OF THE “RELEASE” NAMED BELOW / PLAYERS REGISTERED IN THIS REGISTRATION FORM, including partners; (c) there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time, and I (WE) FULLY ACCEPT AND ASSUME ALL SUCH RISK AND ALL RESPONSIBILITY FOR LOSSES, COST AND DAMAGES I (WE) incur as a result of my participation or that of the minor in the Activity.
3) HERBY RELEASE,DISCHARGE, AND CONVENT NOT TO SUE The Municipality of Toa Baja, the Comite Olímpico de Puerto Rico (COPUR), the Puerto Rico Tennis Association (PRTA), the “Asociación de Tenis de Playa de Puerto Rico (ATPPR)”, the International Federation of Beach Tennis (IFBT), Beach Tennis Life, Corp. (BT Life), AND THEIR AFFILIATES, their respective administrators, directors, agents, officers, members, volunteers and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessors of premises on which the Activity take place, (each considered one of the “RELEASES” herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASES” OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY,ASSUMPTION OR RISK, AND INDEMNITY AGREEMENT I (We), or anyone on my behalf, makes a claim against any of the Releases, I (WE) WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.
4) WILLINGLY CONSENT a) to be filmed, live, taped, or filmed television footage or photos during the tournament days without compensation and that for promotional considerations my (our) image and live videos may be used without compensation before, during and after the tournament days, and hereby waives any right to such compensation for participants, b) The right to grant and/or assign licenses or transfer that right and licenses mentioned herein at their sole discretion to any third party.
5) BY COMPLETING THIS ORDER AND OBTAINING CONFIRMATION OF SUCH ORDER, I/WE (players, parents, agents, custodians) ACKNOWLEDGE OUR AGREEMENT OF ALL THE ABOVE TERMS.
